Just read through the lawsuit, I’m not a lawyer but this would certainly seem to hinge on whether the pegzDAO voted or had intent to vote to release FEELSGOODMAN to pegz holders prior to the auction

More then once in the lawsuit the plaintiff states to understand FEELSGOODMAN was 1 of 100 then complain that it wasn’t unique or 1 of 1

Then they use the Sotheby’s auction as an example of a 1/1 pepe selling for $3mil+ even though that happened after the FEELSGOODMAN auction

not all pepes are equal and as such having more of lame worthless trash is not a good way to rank…
it just promotes buying trash for a vanity metric that is worthless -
