I credited the artist which is required in the Custom Magic circles. The artist hasn't been active since 2019 and didn't respond when I reached out on pixiv/twitter :/ but they don't say no remix/reuse or anything like that (which some artists do call out). Here's the sauce!

i found the sauce yesterday which is why I was curious. personally i thinks its a bit of a liberty you are taking but what do I know. we like a bit of controversy... kudos for making a card whatever my other brain farts are and welcome to the room.

Moral perspective: I'm big into attribution, I license all my art under CC-BY which even allows commercial reuse, as long as there's credit somewhere. In that context I don't feel wrong using the art like I did. It's the same standard as upheld by the Custom Magic community which will call people out for not including attribution when someone posts a new card or proxy.

Precedent perspective: This is most worrying to me, especially with the amount of rip off art that has popped up with the popularity of NFTs. I wouldn't want people to think it's ok to rip art and upload it without any changes or to remix/reuse art when it's been prohibited by the artist.

Legal perspective: Usually fan art of game characters don't prohibit reuse because they themselves are reusing someone else's IP. This is part of an even bigger blind eye turned by the anime industry... JP is usually strict with IP law but the anime industry thrives on fandom and IP creators usually have roots in creating doujin/fan works themselves. I'd be more worried about Nintendo or Wizards of the Coast taking action than Yushiro.

I think it's a fun card and people grin when I share it or give them one of the physical ones I made, so I feel like the MtG/game framing of PKB does have a value add to the character art and the character herself 😊

But ultimately if the card isn't appropriate I won't submit it. I appreciate everyone's feedback and thoughts!

Their first rule is All card renders including art must have artist credit at the bottom of the card in the correct position. Any cards lacking artist credit will be removed. This rule encompasses all card art, including photography and media screenshots.
